Top court annuls rejection of claim for lightning-caused disability

TOKYO — The Supreme Court on Monday quashed a lower court rejection of a civil lawsuit by a man seeking damages for disability caused by lightning striking him during a high school soccer game in 1996. Mitsutoshi Kitamura, 25, was left blind with paralyzed arms and legs as a result of the lightning strike on Aug 13, 1996, in Takatsuki, Osaka Prefecture.
Kitamura and his family filed the lawsuit two and a half years after the incident. The suit seeks damages for his disability from a Kochi Prefecture high school and others. Justice Ryoji Nakagawa said, "A teacher who supervises extracurricular activities has a responsibility to predict the danger of accidents. Considering how cloudy it was and that thunder was heard at the time, it was possible to foresee the danger," he said, quashing the Takamatsu High Court ruling that denied the possibility.
